§ 24-5. Variances.

  • The zoning board of adjustment shall have jurisdiction to hear requests for a variance from the terms of this chapter, except that the zoning board of adjustment shall not hear any request for variance regarding billboards. The board shall be authorized to grant a variance from the terms hereof if, and only if, they find:

    (1)

    That the strict enforcement of this section would create a substantial hardship to the applicant, by virtue of unique special conditions not generally found within the city, and

    (2)

    That the granting of the variance would preserve the spirit and intent of the ordinance, and would serve the general interests of the public and the applicant.

    Sign variances requested for proposed signs in the downtown sign district may also be submitted either to the main street design committee or the main street advisory board for review and recommendation to the zoning board of adjustment.
